Dream Avatar Creator Gaia
First of all, I'd like to say that I am not writing this to bash anyone who uploads gaia avatars for their own use. But, I'm glad that TH banned the sale and trade of them and other doll maker adopts. I just wanted to put my feelings out there.
So yes, of course I also believe that dollmaker adopts shouldnt be traded. That's not exactly why I'm so salty about seeing gaia avatars being used though.
I am an old gaia member. I joined gaia when I was about 12 years old. I am currently 24. When I joined gaia, there was no avi maker. There was kind of one on another website created by someone else, but there was no gaia one on the site. Every item on there you had to earn and collect for your avis yourself. Sure, you could buy gaia cash and purchase some exclusives, but most items were earned. I spent many hours, sometimes staying up all night, playing games for gold. When I finally bought the item I was questing for so long it was the greatest feeling in the world. I got to wear it on my avi as an accomplishment.
R/gaiaonline: A subreddit for Gaia Online. Because the gaia online creator is really bad. Can't believe no other website have done a new dream avatar yet.
One day, I got hacked..and lost everything. I had to start completely over. As a little girl, I was devastated. When I restarted, I got into breedable pets. I actually worked as a colorist to earn back my gold. It was like a real job. I continued to earn everything I wore, only occasionally receiving gifts from friends. Before the big inflation hit, these were treasures. They were my payment for working hard and being apart of the community.
Eventually the knock off avi builder was taken down by gaia after people started using it to sell their creations. It wasnt as bad as it was now though. Users used that builder to make their dream avis and quest for the items. So gaia decided to create the current avi builder that everyone now uses..and that's when things got really bad.
Now anyone on gaia could make avis..and download a full view of the characters.
At first, I didnt think it would be bad. I assumed people would use it the same way they had in the past. Using it to quest for the items they wanted. Instead they used it to create refs for characters. That didnt sound that bad either..but then they started selling those characters as original designs. Now everyone could use the items that I had to grind for hours to get. They became meaningless. People dont understand that those items that they just throw together actually meant something to gaia users like myself. They didnt earn those, they're not even trying to get those anymore. They're just throwing something together and not even bothering to understand what gaiaonline is like..or..used to be like.
Gaiaonline is not the website it used to be. It used to be a fun marketplace, roleplay forum, and community. Now it's only full of people throwing together whatever avis and taking everything else for granted. No one plays anymore, no one tries to earn anything, and if they do want something, they just buy it with real currency. That last thing isnt the fault of the avi maker, but it is an issue.
Gaia is..dying. they admitted this in a recent forum. They are now excepting donations because they can no longer to afford the server space. Too many people are coming for the avi maker and nothing else. Why play games when you can just create whatever you want?
And so that..is why I hate seeing them.
Anyway, please feel free to post comments and questions related to gaia adopts or gaiaonline in general. I havent been there since the very beginning, but damn near.
Reguardless of my personal saltiness, I'm still against the trade or sale of any doll maker adopts but I understand the need for people to use it as a tool to bring their ideas to life.
I used to play Gaia Online back in 2015, and yeah, I agree with all of this. I only used it for its features, and I'm never restricted to this site's dollmaker when I was super into it at the time.
I don't know how long will Gaia Online survive, since it's confirmed that it's dying, but it's an old website, so I'm concerned about its future.
Speaking of its features, getting rewards, socializing with others, and playing games were really fun, especially the Lake Kindred game, which plays like Pokémon, but it's pretty good. I also really love the aquarium feature, too. I wish people weren't too focused on the onsite dollmaker, though.
The fact that people create accounts just for the dollmaker is a big waste imo, and it just takes up a lot of space. I don't think Gaia Online would even survive at a time like this. Oh well..
ETA: I consider it as part of Gaia Online, despite it being on facebook, but Monster Galaxy was my childhood, and I loved playing it when I was younger. It also had mobile games based around Monster Galaxy, but they don't seem to exist anymore..
I used to primarily roleplay on gaia. The forums used to be packed with new roleplays. Now in any one sub forum I can count like five that were replied to..today. The whole page used to be filled with recent replies.
This is how I felt with TinierMe and Dreamselfy. Dreamselfy's name is literally what its purpose: for your 'dream' avatar that you use as a goal and aim for what items/outfits you want for it. When TinierMe closed down, DreamSelfy pretty much lost its original purpose (unless you still play the original Japanese language ver of the game) and people went all out to even sell DreamSelfy designs with dA points.
As you pointed, people spend actual money to get the items/outfits in the game and I felt bad upon the game's shutdown, all those expensive outfits are now 'accessible' for everyone via an avatar maker.
Admittedly, and in defense, I've gotten over that kind of feeling now, and its been years since TinierMe have long gone so there's no need to police around on what we can't do with DreamSelfy and I do admit that the game itself have some really, really nice outfits and designs but selling designs from an avatar maker, even if for just 1$, is a bit..well..because you never claimed the design and there's still certain chances (if we're taking the large pool of outfits/items into account) you'll get a design similar to another for using the same avatar maker.

Wh-where do you hang out? I'm in the GCD every day checking out the CSU threads - people put tons of effort into their avatars there, and they complain about every price increase. 'They pay with real currency' is.. interesting. Most of the regulars save GC for tickets and collabs instead. Everyone tries to buy the new items with plat, there's enough of it to go around & no one wants to spend their irl money, which is why Efficient Slayer is still expensive (though it has gone down to ~60kp).
The knockoff avi builder was tektek (dot) org. It was run by Tekton since Gaia didn't have an avi builder. Eventually Tekton got tired of running it, and in the last few months it was run entirely by volunteers. Remember when there would be huge gaps in new items being added? Perhaps you don't, but basically Tekton was on his way out long before it was shut down. Gaia staff actually supported tektek so long as tektek didn't make any ad revenue, since it was essentially using Gaia's own items on their site. So when Tekton launched his own avatar builder site and advertised it on tektek under the avatar builder, Gaia was kind of forced to send him a cease and desist, and Tekton was fine with doing both, by deleting the site. That's why it was shut down.
Personally I hate the avatar builder images because they're awful small, and they use the sit, turn, and mirror poses, making the image super wide. I find the Dressup builder significantly better due to not being microscopic in size. It's also significantly less laggy. I don't know why anyone would subject themselves to using the avatar builder in the first place..
Back to the GaiaOnline avatars, yeah.. I'm not a huge fan of the images for the avatar builder. Why do we need to include all of the avatar's poses cramped in one image, and just make them long anyway? It just throws me off..
I was an avid role player, and into breedable pets. I did go into the GC on occassion but that was not where I hung out so I would not know about the current status of that. I do however check the roleplays and it doesnt look good..at all. As said in a post to historia, if I were to into let's say..the university subforum.. I can find like five threads that were posted in..today. When I roleplayed there, there was at least two pages of active roleplays with recent posts. As for beedables, most of the shops have died out. There are a few still hanging in there but the forum is more or less the same story.
I was not into the marketplace as much..but I have insight on that. My longest known friend on Gaia is Throttle Kitty. She was actually my gaia father who bought and sold everything. He used his skills to buy one of the first platinum tickets..and then..sell the dolls from it..to get more tickets. (Yeah those tickets are an endless loop. I've seen first hand that the only people who can get their hands on them are ones who have already had them..or shelled out a ton of money to get one. It's rare that someone actually finds one by chance and keeps it.) Anyway, from my friendship with them I know that the market is also messed up. I'm not even going to get into the inflation. Everyone already knows about it. (I have 100+ long stem blue roses on my account that I originally payed 25k gg each for. I dont even want to see what they're worth now.)
Also, gaia yes was aware of the other avi builder..but it wasnt like they supported them. They just acknowledged it existed and shrugged. So yeah, you're right that they didnt take action until the advertising happened..but I wouldnt say they were friends. They just tolerated them.

Gaia is now like FILLED with oddly sexual items..that are just barely not sexy enough to pass as 'acceptable'. Its really messed up.

They used to actually link newbies to it via the Welcome Fairy, so there was positive onsite acknowledgement of tektek. I don't think they would have done that if tektek was a site that they tolerated.
And yeah, a lot of the forums have really slowed down over time.. I was never into the rp or other creative subforums there, so I never really knew how busy it used to be.
EDIT: wrt sexual items: same mood? I mean Gaia's demographic has definitely grown up with the site, but that fairy item (Solimella?) that makes you completely nude if you use an item cutter gets on my nerves. Sure people will 'get creative' no matter what items you give them but.. yiiiikes.
from a designers perspective i always did dislike them.. lack of originality and an easy cash grab for lazy people who wanted to sell something they didnt own.
im sorry to hear about the actual website itself suffering due to this, though. i think if they removed the feature it would be better to an extent

The one forum that I still visit which is slower..but still active are the art ones. Theres still plenty of artists selling their works. You can still get some good freebies there!
Other than that..the places I frequented are just dead. I'm honestly thinking about selling said hoard of roses and just buy artwork for my characters here. Problem is I dont think anyone wants to buy a ton of roses.
This might be a bad example because this item was released when I was active on there, but it's the only one I can think of off the top of my head. Box of Tottally Innocent Obects. It gives you a sexy cop uniform, a stripper pole, and a weenie you can put in your mouth. Also logs on fire. I've witnessed people using buddy items with the weenie..to..um..not gonna say. Yeah that's some creative on the user part..but the item in general was begging for people to do just that with it.
Even if they did that, the site is still toast. If not that, itd probably that inflation that would kill it in the end.
I just remembered something that in hindsight is kind of messed up, yet I'm still nostalgic about it. XD
So like..people used to hold pantie auctions to raise gold for their quests or charity. They'd take like a 200gg pair of basic panties and equip them to their avi and then auction them. 'Spunky's Panties~ Worn by the one and only Spunky Skunk. Auction ends on blah blah date.' (I didnt actually do this, just an example. I did know people who did though and saw it often in my early days.) And these things sometimes sold for like millions of gold. XD

If Gaia felt Tektek's 'Dream Avatar' maker infringed its intellectual property, or that people might legitimately mistake Tektek.org for the official Gaia site, they could've taken action at any point. Instead, Gaia not only declined to take action, but promoted Tektek.org in a guide offered to new users on the Gaia site.
The site was developed and maintained by a fan, using his own time and money. It offered tools which the official Gaia site did not. Gaia benefited from the existence of Tektek.org for eleven years.
Tektek saved Gaia from having to develop and maintain their own dream avatar maker, account worth calculator, quest bars, etc. Many (if not most) Gaians relied on Tektek's tools. The site greatly augmented the Gaia experience and helped it retain its userbase.
Giving people the ability to create dream avatars and quest bars encouraged them to use Gaia more. That in turn meant increased ad revenues and Cash Shop sales for Gaia. If this ever went to court, the judge would almost certainly rule in Tekton's favor. He/she would look at how Gaia not only allowed Tektek to operate for over a decade without taking any legal action, thus setting a precedent of implicit acceptance, but actively promoted Tektek on the Gaia website. Gaia cannot just suddenly decide that Tektek's use of their material constitutes infringement because they don't like an ad being run on the site. Either it's always been infringement, or it's always been fair use.
And if it's always been infringement, why didn't Gaia take legal action eleven years ago? I presume Tekton isn't fighting this because he knows Gaia is a sinking ship. He's dedicated over ten years of his life to Gaia and its community. But, over the last couple of years, Gaia has been reaping the consequences of terrible management. Gold gens have destroyed Gaia's once-thriving virtual economy. Many dedicated and talented employees have either quit or been let go. Management have shown nothing but contempt for the people who create and use Gaia.
The death of Tektek is just another nail in Gaia's coffin. The fact that Gaia have allowed Tektek to operate for eleven years, and even promoted Tektek on the Gaia website, is huge. It essentially invalidates the main argument of the C&D letter, which is that Tektek is intentionally trying to mislead people into thinking Tektek.org is Gaia Online and create 'consumer confusion.' If Gaia legitimately believed this is what Tektek was doing, and that Tektek represented a genuine threat to their intellectual property, they should have acted eleven years ago. The fact they didn't hurts their case today.
The burden of proof is on Gaia to show that Tektek is creating 'consumer confusion.' That people are mistaking (or could reasonably mistake) tektek.org for Gaia, and that this is hurting their business. The C&D letter doesn't mention the ad for recolor.me, only the 'Tektek Site.'
Sites that depend on fair use claims (for example, Wikia) are allowed to run ads to help defer server and staff costs. IP owners cannot pick and choose which ads are okay. The impact on free speech would be devastating if they could. Movie studios could shut down blogs that posted negative reviews, claiming that they are infringing the studio's IP (movie stills and quotes included in reviews) to promote 'competitors' (DVD recs in Amazon sidebar). They could crush small independent productions the same way.
If a movie blogger was trying to fund their own film, and had a link to their PayPal/Kickstarter in the sidebar, they could claim it was an 'ad' for a 'competitor.' Tektek should be in the clear as long as it: -Makes it clear that whatever ads it runs are ads. -Doesn't imply that Gaia endorses whatever is being advertised in said ads. -Doesn't use Gaia's IP for purposes of profit or promotion (e.g. Using Gaia avatars in ads for Recolor, selling Red Bubble shirts featuring Gaia art, etc). I was using Gaia again just now, after 8 years of absence.
Had some free time on my hands and thought of it; starting poking around the marketplace - one of my old stomping grounds - and of course had to look into updating my avi. Gaia wasn't quite as awful when I fell away eight years ago, but it had it's foot in the door when I tried to come back after the first two years being away. I won't even waste my time falling further down this rabbithole since tektek was imperative to my Gaia XP, though I was so excited to. Painful, this is.
